As a seller it is best not to describe the property by its address.  Rather describe it exactly as it appears in the registered title, for example

  • (for an erf) not “11 Church Street, Claremont” but “erf 1234 Cape Town”
  • (for a sectional title unit) not flat number 3 Mountain View with parking bay”, but “unit 103 in the sectional scheme Mountain View,  situate at Cape Town in the City of Cape Town with exclusive use areas P3 and balcony B3”
  • for farms, not “Welgevonden, Stellenbosch” but portion 1 of farm number 123 Stellenbosch…

The correct description can be found on the seller’s title deed, or on a deeds search on the property that can be found online through services such as Windeed.  The agent should also be able to assist.

The buyer would prefer to describe the property by the address, to try to be sure of what is being bought.   But the voetstoots clause is still against the buyer (see below) so it is best for it to be clear that the buyer must make sure of what is being bought.
